In the state of New Jersey, a DWI is classified as a traffic violation under N.J.S.A. 39:4-50, rather than a felony or misdemeanor. However, it is treated with the gravity of a serious crime. - BAC 0.08% to Under 0.10%: Mandatory IID installation for three months. Driving privileges are typically restored once the Motor Vehicle Commission (MVC) receives proof of installation.
- BAC 0.10% to Under 0.15%: Mandatory IID installation for seven to twelve months.
- BAC 0.15% or Higher: A mandatory license suspension of four to six months. Following reinstatement, an IID must remain installed for an additional nine to fifteen months.
- DWI Involving Drugs: In cases involving narcotics or habit-producing drugs, offenders face a mandatory license forfeiture of seven months to one year, as interlock devices are designed for alcohol detection only.
Second and Subsequent Offenses
Repeat offenses within a 10-year period carry progressively harsher consequences:
- Second Offense: Fines between $500 and $1,000, 30 days of community service, 48 hours to 90 days of jail time, and a license suspension of one to two years. An IID is required during the suspension and for two to four years after reinstatement.
- Third or Subsequent Offense: A fine of $1,000, a mandatory 180 days in jail (with up to 90 days allowed in an approved inpatient program), and an 8-year license suspension followed by a multi-year IID requirement.
The Ignition Interlock Credit System
New Jersey law now includes a “2-for-1” ignition interlock credit incentive. In eligible alcohol-based cases where no serious injury occurred, drivers may earn one day of credit against their mandatory license forfeiture period for every two days the IID is properly installed and maintained.
Voluntary Pre-Conviction Installation: Certain defendants can choose to install a state-approved IID after an arrest but before their case is fully adjudicated. This “early installation” strategy can demonstrate good faith to the court and may significantly reduce the total time a driver is prohibited from operating a vehicle.
