In New Jersey, the burglary statute can be found in Title 2C, Chapter 18—Burglary and Other Criminal Intrusion. The crime is charged as either a second-degree or third-degree offense. - Trespass in or upon utility company property where public notice prohibiting trespass is given by conspicuous posting, or fencing or other enclosure manifestly designed to exclude intruders.

Burglary Penalties Convictions in New Jersey
When someone hires a criminal attorney for burglary charges, it’s their hope that they can avoid serious penalties. Unfortunately for defendants, the penalties for a conviction are extremely strict. In fact, sentencing guidelines for burglary are among the most strict outside of homicide cases. Keep in mind that the following penalties are specific to burglary — not any underlying crime that was committed during unlawful entry into a structure.
This means it’s possible to see sentencing far more severe than discussed here. Burglary is a crime of the second degree if in the course of committing the offense, the actor:
- Purposely, knowingly or recklessly inflicts, attempts to inflict, or threatens to inflict bodily injury on anyone; or
- Is armed with or displays what appear to be explosives or a deadly weapon.
Otherwise, burglary is a crime of the third degree. N.J.S.A. 2C:18-2.
Crimes in the first degree can be punishable from 10 years to 20 years in New Jersey State Prison. Crimes in the second degree can be punishable from 5 years to 10 years in New Jersey State Prison. Crimes in the third-degree range can be punishable from 3 years to 5 years in the New Jersey State Prison.
The Sentencing Judge may also order fines and restitution as prescribed by N.J.S.A. 2C:43-3 for all convictions for Burglary in New Jersey.
