Burglary in New Jersey

In New Jersey, the burglary statute can be found in Title 2c; Chapter 18- Burglary and Other Criminal Intrusion. A person is guilty of burglary if, with a purpose to commit an offense therein or thereon he:

• Enters a research facility, structure, or a separately secured or occupied portion thereof unless the structure was at the time open to the public or the actor is licensed or privileged to enter; or
• Surreptitiously remains in a research facility, structure, or a separately secured or occupied portion thereof knowing that he is not licensed or privileged to do so; or
• Trespasses in or upon utility company property where public notice prohibiting trespass is given by conspicuous posting, or fencing or other enclosure manifestly designed to exclude intruders.

Burglary Penalties Convictions in New Jersey

• Burglary is a crime of the second degree if in the course of committing the offense, the actor:
• Purposely, knowingly or recklessly inflicts, attempts to inflict or threatens to inflict bodily injury on anyone; or
  Is armed with or displays what appear to be explosives or a deadly weapon.

Otherwise, burglary is a crime of the third degree.

Crimes in the first degree can be punishable from 10 years to 20 years in New Jersey State Prison. Crimes in the second-degree can be punishable from 5 years to 10 years in New Jersey State prison. Crimes in the third-degree range can be punishable from 3 years to 5 years in the New Jersey State prison. Crimes in the fourth-degree range can be punishable up to 18 months in New Jersey State prison. Disorderly persons offenses can be punishable up to 6 months in the County jail usually in the County where the crime was committed.

The Sentencing Judge may also order fines and restitution as prescribed by 2C:43-3 and for all convictions for Burglary in New Jersey.
